HOBART ANNIVERSARY Celebration CONTEST - OFFICIAL RULES - Independent RESTAURANT

 

NO PURCHASE NECESSARY TO ENTER OR WIN.  The Hobart Anniversary Contest (Restaurant) is a trade promotion that begins on May 5, 2022 and ends on October 31, 2022 (“Contest Period”).  The Contest is sponsored by Hobart, 701 S. Ridge Ave., Troy, OH 45374 (“Sponsor”).  Participation in this Contest constitutes the Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects.  

This Contest will consist of several phases, as outlined here:

  • Initial entry period: May 5th, 2022 to July 31st, 2022. 
  • Entry Review and Finalist Selection and Notification: August 1st, 2022 to August 15th, 2022.
  • Finalist video submission deadline: September 15th, 2022.
  • Finalist Review, Selection, and Announcement: by October 31, 2022.

 

 

ELIGIBILITY: The Contest is open to stores located in the 50 United States and the District of Columbia, who meet the criteria of an “Independent Restaurant” as set forth in these Official Rules.  For purposes of the Contest, the “Independent Restaurant” must operate no more than nine (9) locations, be in operation at the time of entry, and have been in business for no less than two (2) years.  For the avoidance of doubt, locations under different "concepts" or names but with common ownership will count towards the 9-location maximum calculation. Only one entrant per store location.  If the Entry is not submitted by the owner or manager of the Independent Restaurant, then the person submitting the entry confirms by entering that he or she has received permission from the owner or manager to submit.  Employees, contractors, directors and officers of Hobart, its parent, subsidiaries and affiliated companies and the advertising, fulfillment, legal, administrative and promotion agencies involved in the Contest and their immediate family members, and those living in the same household, are not eligible to enter or to win.  All federal, state, and local laws apply. Void where prohibited by law. 

 

HOW TO ENTER:  To enter, visit www.hobartcorp.com/125-years/contest and fill out the entry form, including contact information, and a narrative about your business which addresses the following two issues: (1) Describe the level and involvement of local philanthropy and community outreach that your restaurant has engaged in since opening, including information on service and impact in the local community; and (2) Describe your equipment needs to continue to operate your restaurant and continue to provide the community outreach that you have been providing.  The answer to each narrative question cannot exceed 500 words.  Entries and narratives will be reviewed and judged as set forth in these Official Rules.

 

After the initial review of entries, Sponsor will notify up to ten (10) entrants that they will be deemed finalists (“Finalists”), and the Finalists will then prepare and submit a video submission as the second part of the entry process.  These video submissions will be approximately 2-3 minute videos and will enable entrants to expand upon the unique stories of community outreach and corresponding need for the new equipment to take their efforts to the next level.  Full details on video submission guidelines and requirements will be provided to Finalists when notified.  Selection criteria for the video submissions will be the same as for the narratives, as outlined below.  Video submissions will be reviewed and judged as set forth in these Official Rules.  For purposes of these Official Rules, an “Entry” includes the entry form, narrative, and video submission (if requested).

 

Sponsor is not responsible for incorrect, inaccurate or incomplete entry of information by Entrants; lost Entries or transmissions, interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to Entrant’s systems.    

 

An Entry may, in Sponsor’s sole and absolute discretion, be disqualified if it is late, illegible, incomplete, damaged, destroyed, forged, contains objectionable material, fails to follow Sponsor’s requirements disclosed in these Official Rules, or for any other reason.  Entries generated by script, macro or other automated means and Entries by any means which subvert the entry process are void.  All Entries become the property of Sponsor and will not be acknowledged or returned. 

 

In the event of a dispute as to the identity of any Entrant who submits an Entry, the Entry will be deemed submitted by the account holder of the email or other account from which it was sent/posted, but only if such person is otherwise eligible.  The “account holder” is the person assigned an email address or username by the entity responsible for assigning it (e.g., Yahoo).  Entrants may be required to show proof of being the registered account holder.  If a dispute cannot be resolved to the Sponsor’s satisfaction, the entry will be deemed ineligible.  Sponsor is not responsible for lost, misdirected, misplaced, stolen, tampered with, deleted, or invalid Entries. 

 

Sponsor, in its sole discretion, reserves the right to disqualify Entries containing any of the following: (a) words, images or statements that are or could be considered offensive to individuals on the basis of age, race, ethnicity, national origin, religion, sexual orientation, disability status, veteran status or any characteristic protected from discrimination by the laws of the United States; (b) unauthorized use of the intellectual property of a third party; or (c) content inconsistent with Sponsor’s reputation and image. 

 

PRIZES:  One (1) winner will be selected to win:

  • Their choice of Hobart dishwashing equipment with retail value up to $11,000.
  • Their choice of Hobart food preparation equipment with retail value up to $25,000.
  • Installation of selected equipment and one (1) year of preventive maintenance
    (from time of installation) with combined total retail value up to $10,000.

 

 

Approximate retail value of prizes: $46,000.  No substitution or transfer of any prize or election of cash in lieu of any prize by Winner will be permitted. Sponsor reserves the right to substitute any prize of equal or greater value if any prize or portion of a prize becomes unavailable for any reason. Prizes are nontransferable. Prize delivery may be delayed based on supply chain and production delays, and items may ship later than originally stated.  All federal, state, and/or local taxes are the sole responsibility of Winner.  Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the sole responsibility of Winner. 

 

JUDGING AND WINNER SELECTION:  Each Entry will be reviewed and judged by a team of Sponsor’s representatives, and will be scored based on the following two (2)  “Judging Criteria”:

(a) Local Philanthropy and Community Outreach: A maximum of one-hundred (100) points may be awarded based on the level of proactive service and positive impact in the entrant’s local community. 

(b) Equipment Needs as Demonstrated: A maximum of one-hundred (100) points may be awarded based on the demonstrated Equipment needs in relationship to ability to positively impact local community outreach initiatives.

 

This is a contest based on skill, and the odds of winning will depend on the quality of the Entries received and the relative skill of the Entrants. 

The Entry that earns the highest score, out of a total of two-hundred (200) points based on the Judging Criteria, will be declared the potential Winner.  The potential winner will be subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules.  In the event of a tied score between Entries, the Entry that received the most points in the Local Philanthropy and Community Outreach category of the Judging Criteria will become the potential Winner.

 

Any Entrant offering or using, or attempting to use a payment, or other incentive (such as, the offer or acceptance of any benefit, compensation, gift or award in conjunction with judging or not judging a given Entry), may be disqualified and any submissions earned by those means may be void, in Sponsor’s sole discretion.  The potential Winner will be notified on or about October 31, 2022.  BEFORE BEING DECLARED A WINNER, POTENTIAL WINNER MUST SIGN AND RETURN, WITHIN FOURTEEN (14) DAYS OF BEING NOTIFIED, AN AFFIDAVIT OF ELIGIBILITY/COMPLIANCE & PUBLICITY/LIABILITY RELEASE FORM AND PROVIDE ANY OTHER BIOGRAPHICAL INFORMATION OR DOCUMENTATION REASONABLY REQUESTED BY SPONSOR IN CONNECTION WITH THE CONTEST (collectively “Prize Acceptance Documents”).  If a potential Winner cannot be contacted after the first attempt to contact him/her, or if he/she fails to sign and return the Prize Acceptance Documents within the required time period, or is disqualified for any reason, Sponsor may name an alternate potential Winner selected in accordance with the selection criteria described above.

 

REPRESENTATIONS AND WARRANTIES OF ENTRANT:  By entering the Contest, Entrant represents and warrants that: (a) the Entry (including the narrative and any video submission, if requested) is wholly original to and created by them and has not been copied, in whole or in part, from any other work; (c) the Entry does not infringe upon or otherwise violate the copyright, trademark, publicity, privacy or other proprietary rights of any third party; and (d) they have the full and exclusive right and authority necessary to submit the Entry without permission from any third party.

 

LICENSE TO USE ENTRY AND RIGHTS WAIVER:  Entrant acknowledges and agrees that the Entry becomes the sole and exclusive property of Sponsor and may be used in any manner, in any media now known or hereafter created, worldwide in perpetuity.  Entrant grants to Sponsor, and its agents and assigns (collectively, the “Rights Holders”), the irrevocable, perpetual, worldwide, royalty-free, transferable right and license to use, reproduce, modify, perform, exhibit, distribute and/or otherwise exploit the Entry in any media now known or hereafter created and in any manner, including use for advertising, promotional or other commercial purposes (the “License”).  Entrant agrees that he/she shall not be entitled to any compensation for any exercise of such rights beyond the consideration explicitly set forth herein.  Entrant further understands and agrees that the Rights Holders may edit, alter or modify the Entry in any manner and for any reason. 

 

PUBLICITY RELEASE:  Except where prohibited by law, Winner grants Sponsor (which grant will be confirmed in writing on request of Sponsor), its parent company, subsidiaries, affiliates, advertising agencies, and those acting pursuant to their authority, the right and permission to print, publish, broadcast, and use, worldwide, in any media now known or hereafter created, including but not limited to the Internet, at any time, the Winner’s name, picture, voice, likeness, and biographical information for advertising and promotional purposes (including the announcement of his or her name on social media) without additional consideration, compensation, permission, or notification.

 

PRIVACY:  Any personal information sent to, shared with or collected by Sponsor in connection with this Contest is subject to Sponsor’s Privacy Policy at Privacy Policy | Hobart (hobartcorp.com).

 

CONDITIONS:  Sponsor, agents and representatives of Sponsor, its parent company, affiliates, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, platform, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Contest; or (v) any printing or typographical errors in any materials associated with the Contest.  Sponsor reserves the right, in its sole discretion, to suspend or cancel the Contest at any time and for any reason including, but not limited to, a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Contest.

 

Sponsor reserves the right to cancel the Contest or change any element thereof, with or without notice, at any time, due to printing errors, web site errors, transmission errors or other mistakes or problems in the production or administration of the Contest.  The Releasees (defined below) are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email or other account to receive messages. 

 

ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR MAY DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Entrant releases, discharges, holds harmless, and covenants not to sue Sponsor, its parent company, subsidiaries, affiliated and successor companies, licensees, affiliates and advertisers, and their respective officers, directors, agents and employees (collectively, “Releasees”) from and against any claims or liabilities arising from or relating to the submission of any Entry, selection of winners, disqualification of any Entry, the posting or other use or dissemination of any Entry, use of any of the rights granted by Entrant, the acceptance or use/misuse of any prize, and any other claim or liability of any nature arising from or relating to Entrant’s participation in the Contest, including, without limitation, any claim for personal injury, wrongful death, breach of contract, misrepresentation, invasion of privacy or right of publicity, defamation, infliction of emotional distress or otherwise.  In the event Sponsor is prevented from continuing with the Contest by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Contest.

ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR MAY DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Entrant releases, discharges, holds harmless, and covenants not to sue Sponsor, its parent company, subsidiaries, affiliated and successor companies, licensees, affiliates and advertisers, and their respective officers, directors, agents and employees (collectively, “Releasees”) from and against any claims or liabilities arising from or relating to the submission of any Entry, selection of winners, disqualification of any Entry, the posting or other use or dissemination of any Entry, use of any of the rights granted by Entrant, the acceptance or use/misuse of any prize, and any other claim or liability of any nature arising from or relating to Entrant’s participation in the Contest, including, without limitation, any claim for personal injury, wrongful death, breach of contract, misrepresentation, invasion of privacy or right of publicity, defamation, infliction of emotional distress or otherwise.  In the event Sponsor is prevented from continuing with the Contest by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Contest.
