2024 Holly Jolly Hobart Contest Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. 

BY ENTERING THIS CONTEST, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU, A CLASS-ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. 

The 2024 Holly Jolly Hobart Contest (the “Contest”) will commence at 12:00:00 A.M. Eastern Standard Time November 29, 2024 and end at 11:59:59 P.M. Eastern Standard Time December 20, 2024 (the “Contest Period”). The Sponsor of this promotion is Hobart, 701 S. Ridge Ave., Troy, OH 45374, USA (“Hobart” or “Sponsor”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Contest.  Subject to all applicable federal, state, and local laws and regulations. 

THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM INCLUDING WITHOUT LIMITATION TWITTER, TIKTOK, PINTEREST, LINKEDIN, OR FACEBOOK OR INSTAGRAM FROM META (“SOCIAL MEDIA PLATFORM(S)”). SOCIAL MEDIA PLATFORMS ARE NOT RESPONSIBLE FOR THE PROMOTION, ADMINISTRATION OR EXECUTION OF THIS CONTEST.

ELIGIBILITY: The Contest is open to (A) legal U.S. residents age 18+ currently residing in the 50 United States and the District of Columbia, who (B) are owners of Hobart foodservice equipment, or whose place of work features Hobart foodservice equipment, prior to the start of the Contest Period.

Employees, officers, and directors of Sponsor or Sponsor’s parents, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (the “Released Entities”) are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Contest. Sponsor reserves the right to verify the eligibility of winners. In the event of a dispute concerning the identity of a participant, the entry will be declared to have been made by the registered account holder of the Social Media Account used for entry, but only if that person meets all other eligibility criteria, otherwise the entry may be disqualified, and any potential prize won will be forfeited in Sponsor’s sole discretion.

Note that entrants may be subject to rules imposed by their employers relative to their participation in promotions and may require permission from their employer to enter and win. Entrants should check with their employer for any relevant policies. By entering, participant represents that they have the permission and/or consent of their employer to enter the Contest.

HOW TO ENTER: Participants may enter the Contest by taking the following two Actions during the Contest period. Taking both actions will qualify as one (1) entry, for a maximum of one (1) entry into the Contest:

• Action 1: Spruce up your Hobart equipment with holiday cheer and snap a photo; and
• Action 2: Post a picture of your spruced up Hobart equipment on Instagram (@hobartfoodequipment) or Facebook (Hobart Food Equipment and Service), tag Hobart Food Equipment and Service’s social handles in the post caption, and use the hashtag #2024hollyjollyhobartcontest in your post caption.

The creation and use of a Social Media Account are subject to the Social Media Platform’s application terms and conditions. You will be required to set your Social Media Account to “Public” in order to participate in the Contest. You may not enter more times by using multiple e-mail addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Hobart.

Your entry will not be deemed valid for the Contest unless (a) it meets the requirements set forth above; (b) complies with the rules of the Contest and the rules of the Social Media Platform; (c) does not contain obscene, offensive or objectionable imagery or language, or communicates a message inconsistent with the positive images to which Sponsor, in its sole discretion, wishes to associate; and (d) does not infringe, misappropriate or violate the rights of any third party. Limit one (1) entry per person regardless of the Social Media Platform used to enter the Contest. Entries that are not received by Hobart for any reason will not be eligible and will be disqualified.  Multiple participants are not permitted to share the same email address or Social Media Account. Hobart is not responsible for lost, misdirected, false, corrupted, illegible or late entries. Hobart shall have the sole discretion to determine the validity of an Entry. All potential winners are subject to verification before any prize will be awarded.  Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified.

Sponsor reserves the right to verify the eligibility of winners. In the event of a dispute concerning the identity of a participant, the entry will be declared to have been made by the registered account holder of the social media account used for entry, but only if that person meets all other eligibility criteria; otherwise the entry may be disqualified, and any potential prize won will be forfeited in Sponsor’s sole discretion.  Sponsor’s clock will be the official timekeeper for the Contest.

PRIZE SELECTION: Within a reasonable time period following the conclusion of the Contest Period, on or around December 20, 2024, two (2) potential winners will be selected by a panel of judges to be determined by Sponsor, who will vote and determine the two winners based on the following equally weighted criteria: (1) originality, (2) creativity, (3) holiday spirit, and (4) festiveness.  In the event of a tie among entries exceeding the number of prizes to be awarded, the tied entries will be submitted for further judging by a single judge appointed by Sponsor to serve as the tie-breaking judge.  The decisions of Sponsor and/or all judges chosen by the Sponsor will be final.All potential winners must respond via direct message through the Social Media Platform within seven (7) days of the original direct message or will forfeit the prize. Prior to being confirmed as a Winner, each potential winner may be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within the time period communicated by Sponsor. Refusal to do so will result in forfeiture of the prize. If a potential winner cannot be contacted within seven (7) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any potential winner fails to return his/her winner documents within the time set forth above or otherwise rejects his/her prize, or in the event of noncompliance with these Contest Official Rules, such potential winner will forfeit such prize and an alternate eligible winner may be selected from all remaining eligible entries, time permitting. Upon prize forfeiture, no compensation will be given. Potential winners must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.

PRIZES/ARV:

Prize: Two (2) winners will each receive a Power Bank ($21.00), Hobart Apron ($18.50), Hobart Plush Texture Blanket ($37.75), Hobart Bluetooth Speaker ($40.25), Hobart Beanie ($33.25), and Backpack ($97.00). Approximate Retail Value (“ARV”) of each Prize: $247.75.  Total Prize ARV: $495.50.

Prizes are not negotiable with the Winners. Prizes are non-transferable, and no substitutions are allowed except by Sponsor who may award a prize for one of equal or greater value for any reason. If a prize is not claimed within the designated time period, an alternate potential winner will be selected from all remaining eligible entries.  Sponsor will not replace any lost or stolen prizes.  Only the number of prizes stated in these official rules is available to be won in the Contest.

Winners are solely responsible for all applicable federal, state and local taxes and fees, including income or local personal property taxes, insurance, licensing, registration and title fees arising out of the receipt and use of the prizes. Any difference between the stated estimated value of a prize and its actual value will not be awarded.

SPONSOR’S RIGHTS. Participation in Contest constitutes Entrant’s grant to Sponsor, and its partners and designees, the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to the entry submission, and Entrant’s name, address (city and state), likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by Entrant regarding the Contest or the prize(s) for advertising and promotional purposes without limitation, in any and any media now known or hereafter invented, worldwide, without notice or additional compensation or consent, except where prohibited by law. By entering, you agree that your Entry will be reviewed by Sponsor and may be posted online to a gallery or featured in Sponsor’s social media channels or other advertising, in Sponsor’s sole discretion, to be viewed by members of the general public. All Entries that meet the Contest eligibility requirements will be entered for a chance to win, regardless of whether they are featured or posted by Sponsor.  By entering, each entrant warrants and represents that his/her Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances.

GENERAL CONDITIONS. By participating in this Contest, each Entrant represents that there is no legal or contractual restriction barring participation, including, without limitation, any restriction from participant’s employer or company. Entrants agree to release, indemnify and hold harmless the Released Entities and the Social Media Platforms from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on copyright, trademark, publicity rights, defamation or invasion of privacy, merchandise delivery or breach of any representation or warranty by Entrant.

In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the e-mail address used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or is the owner of the social media account used for the entry at issue. Any potential winner may be requested to provide proof that such winner is the authorized account holder of the e-mail address associated with the winning entry or other proof of identity. The Released Entities are not responsible for technical, hardware, software, network or other communications malfunctions, errors or failures of any kind, lost, interrupted or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend this Contest should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, winner(s) will be selected from all eligible participants prior to and/or after (if appropriate) the action taken. Entrants who do not comply with these Official Rules or attempt to interfere with this Contest in any way shall be disqualified. Released Entities are not responsible for any typographical, display, input, or other error in any Contest materials, or for any errors or problems which may occur in connection with the administration of the Contest, the processing of entries, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won.

IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST AND/OR USE OR MISUSE OF ANY PRIZES. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

By entering the Contest, Entrants affirm that they have read and accepted these Official Rules.

PRIVACY:  Information collected from Entrants is subject to Sponsor’s Privacy Policy, which can be found at https://www.hobartcorp.com/notices/privacy. By entering this Contest, you agree to the use of your personal information as described in the above Privacy Policy.

DISPUTES/CHOICE OF LAW:  Except where prohibited, each Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Miami County, Ohio, and each Entrant irrevocably consents to the jurisdiction of such courts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (4) each Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. This Contest is governed by the laws of the State of Ohio, without regard to conflict of law doctrines.

WINNERS: For a list of winners, please send a self-addressed stamped envelope labeled “2024 Holly Jolly Hobart Contest Winner’s List Request” by January 20, 2025 to 701 South Ridge Avenue, Troy, Ohio, 45374.
